1. Acceptance of Terms
By accessing and using the online platform mylensfolio.com, the user declares to have read, understood, and fully accepted these Terms of Use. If you do not agree with any of the terms established here, you should not use our services.
2. Definitions
- Platform: Refers to the service "mylensfolio.com" and all its components
- User/Photographer: Person or entity that creates an account on the platform to sell photos
- End Client: Person who purchases photos through the platform
- Content: Photos, images, texts, and other materials uploaded to the platform
- Plan: Subscription mode chosen by the user
3. Registration and Account
3.1. To use the platform, the user must create an account providing true, complete, and updated information.
3.2. The user is responsible for the confidentiality of their password and for all activity that occurs on their account.
3.3. We reserve the right to refuse or cancel accounts that violate these terms or that are used for illegal activities.
4. Plans and Payments
4.1. The available plans and respective prices are defined on the platform and may be changed upon 30 days prior notice.
4.2. Payments are processed through the methods available on the platform and are subject to the terms of the respective payment processors.
4.3. Paid plans can be renewed by the user in the "Account" section in the control panel. If the account is not renewed in time, the control panel becomes limited to only that section.
5. Copyright and Content
5.1. The user retains all copyrights over the photos they upload to the platform.
5.2. By uploading content, the user grants the platform a non-exclusive license to store and display the photos to end clients.
5.3. It is strictly prohibited to upload content that violates third-party copyrights or that is illegal, offensive, or inappropriate.
5.4. Photos uploaded to the platform are automatically resized to small size. We are not responsible for file loss, nor is there a file download option. We are not a storage service.
6. Commission Payment
6.1. The platform charges a commission on each sale made, as defined in the plan chosen by the user.
6.2. Commission payments are processed by the user in the "Account" section of the control panel, at any time provided they reach a minimum of 20 Euros up to 75 Euros.
6.3. Upon successful payment, the user will again have access to the entire control panel.
7. Responsibilities
7.1. The user is exclusively responsible for the content they upload and the sales made through the platform.
7.2. The platform is not responsible for disputes between photographers and end clients, acting only as a technical intermediary.
8. Privacy and Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).
9. Limitation of Liability
The platform is provided "as is". We do not guarantee that the service will be uninterrupted or error-free.
10. Changes to Terms
We reserve the right to modify these Terms of Use at any time. Changes will be communicated to users in advance.
11. Applicable Law and Forum
These Terms are governed by Portuguese law. Any dispute will be submitted to the court of Viseu district.
